Kurz-Biografie

Professorin Anuscheh Farahat studierte Rechtswissenschaften in Frankfurt, Paris und Berkeley. Ihre Promotion erfolgte 2011 an der Goethe-Universität Frankfurt a.M. Von 2006 bis 2009 war sie wissenschaftliche Mitarbeiterin und von 2014 bis 2017 wissenschaftliche Referentin am Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht in Heidelberg. 2020 wurde sie am Fachbereich Rechtswissenschaft der Goethe-Universität Frankfurt a.M. habilitiert.

Ihr Buch Progressive Inklusion: Zugehörigkeit und Teilhabe im Migrationsrecht (Springer Verlag, 2014) wurde mit zahlreichen Preisen ausgezeichnet, zuletzt mit dem Herman-Mosler-Preis 2015 der Deutschen Gesellschaft für Internationales Recht. 2021 erschien ihr Buch Transnationale Solidaritätskonflikte: Eine vergleichende Analyse verfassungsgerichtlicher Konfliktbearbeitung in der Eurokrise bei Mohr Siebeck.

Anuscheh Farahat ist seit März 2019 Professorin für Öffentliches Recht, Migrationsrecht und Menschenrechte an der Friedrich-Alexander-Universität Erlangen-Nürnberg. Sie leitet die interdisziplinäre Forschungsgruppe „Transnationale Solidaritätskonflikte“.
2022 wurde sie zum Max-Planck-Fellow am MPI für Sozialanthropologie in Halle ernannt, wo sie ein Forschungsprojekt mit dem Titel “JUST MIGRATION: Labour migration regimes in transnationalised contexts” leitet.

 

Short Bio

Professor Anuscheh Farahat is Professor of Public Law, Migration Law and Human Rights Law at the University of Erlangen-Nürnberg. She  leads an Emmy-Noether research group on the role of constitutional courts in transnational solidarity conflicts in Europe, which is funded by the German Research Foundation (Deutsche Forschungsgemeinschaft). Recently, she has been appointed Max Planck Fellow at the Max Planck Institute for Social Anthropology in Halle with her project “JUST MIGRATION: Labour migration regimes in transnationalised contexts”.

Anuscheh studied law in Frankfurt, Paris and Berkeley. She received her PhD in law from the Goethe University Frankfurt. Her book on migrant citizenship and transnational migration in Germany (Progressive Inklusion: Zugehörigkeit und Teilhabe im Migrationsrecht, Springer Verlag, 2014) has received multiple awards, including the Herman-Mosler-Prize 2015 of the German Society of International Law. In 2021 she published a monograph on transnational solidarity conflicts and the role of constitutional courts in comparative perspective with Mohr Siebeck (Transnationale Solidaritätskonflikte: Eine vergleichende Analyse verfassungsgerichtlicher Konfliktbearbeitung in der Eurokrise). Anuscheh Farahat publishes widely on issues of European and German constitutional law, German and international migration and citizenship law, international Human Rights Law and comparative constitutionalism with a specific focus on solidarity conflicts.

  • FAU Human Rights Clinic

    Abstract

    In fachübergreifender Zusammenarbeit soll an der FAU eine Menschenrechtsklink (Human Rights Clinic) entstehen. In einer Human Rights Clinic werdenPraxisprojekte durchgeführt, die Studierenden Raum für die Vertiefung vonfachlicher Expertise und für die Entwicklung von berufsorientierten Kompetenzengeben. Die Studierenden arbeiten unter Anleitung des Clinic-Personals und in Absprache mit außeruniversitären Partnernan einem akuten Menschenrechtsproblem und entwickeln Lösungsansätze. Anders alsdie etablierten, rein juristisch arbeitenden Clinics wollen wir im Einklang mit dem interdisziplinärenMenschenrechtsprofil der FAU ein Format entwickeln, in dem neben derjuristischen Expertise auch politikwissenschaftliche Expertise integriertwerden soll. Entsprechend werden auch die Studierenden aus beiden Fachgebietenkommen.

    Abstract

    Das Forschungsprojekt rekonstruiert Konflikte über Fragen der Anerkennung und Verteilung, die sich im Zuge der Finanz- und Wirtschaftskrise in der EU intensiviert haben, als transnationale Solidaritätskonflikte. Es analysiert insbesondere die Rolle von nationalen Verfassungsgerichten und europäischen Gerichten in diesen Konflikten.

    Abstract

    Places of Safety in the Mediterranean: The EU’s Policy of Outsourcing Responsibility

    Over the last six  years, more than 19,000 people have lost their lives in the Mediterranean. After the European Union decided to cease ship patrols in the frame of Operation Sophia in March 2019, no EU or national search and rescue vessels are any longer in place to prevent more deaths. By stopping rescue activities in the Mediterranean, EU governments have outsourced their responsibility for saving lives. Nongovernmental organisations stepping in and trying to fill this gap have been increasingly criminalised and prosecuted. At the same time, EU Member States and the European Commission have explored ‘regional disembarkation platforms’ outside the European Union since 2018. Against this background, the Brussels office of the Heinrich Böll Foundation has commissioned Prof. Dr. Anuscheh Farahat and Prof. Dr. Nora Markard to write a study which examines the concept of ‘Places of Safety’ and legally assess whether Algeria, Egypt, Libya, Morocco and Tunisia can be considered places of safety for migrants and refugees. The study also analyses the legal situation when rescued persons are disembarked in unsafe places by EU Member State vessels, when a Maritime Rescue Co-ordination Centre orders private vessels to disembark rescuees in unsafe places or to stand by while third country authorities proceed to the rescue followed by disembarkation in unsafe places.On 19 February, the study ‘Places of Safety in the Mediterranean: The EU Policy of Outsourcing Responsibility’ will be presented by the authors. The presentation will be followed by a discussion on the political implications arising from its findings
